Agreement
These Terms of Use ("Terms") are a legal agreement between you and Flutty AI, Inc. ("Flutty", "we", "us", or "our"). By creating an account, signing in, using Flutty, starting checkout, publishing a site, or otherwise accessing the service, you agree to these Terms and the Privacy Policy.
Product
Service scope
Flutty provides a hosted website-generation workflow that includes prompting, editing, previewing, runtime tools, connectors, analytics, and publishing to Flutty-managed hosting. Features may evolve, be rate-limited, or be marked beta, experimental, or limited access.
Responsibility
Accounts and eligibility
You must provide accurate account information, keep credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity that occurs through your account.
Rules
Acceptable use
You must use Flutty only for lawful purposes and in compliance with these Terms, the Acceptable Use Policy, provider policies, and applicable laws.
Abuse, overload, scan, scrape, disrupt, reverse engineer, or attempt unauthorized access to the service.
Upload, generate, publish, or distribute unlawful, infringing, deceptive, malicious, abusive, hateful, or harmful content.
Use Flutty to distribute malware, phishing, spam, credential theft, scams, or abusive traffic.
Interfere with security controls, quotas, rate limits, billing controls, or audit logs.
Use generated output in a way that violates third-party rights, platform rules, or applicable law.
Ownership and responsibility
Your content and generated output
You retain ownership of prompts, files, branding, data, code, and other content you submit to Flutty. You grant Flutty a worldwide, non-exclusive, royalty-free license to host, process, transform, display, reproduce, and transmit your content solely to operate, secure, support, and improve Flutty.
Commercial terms
Billing and subscriptions
Paid features require an active subscription or payment. Fees, included quotas, renewal terms, billing interval, taxes, and payment provider details are shown at checkout, in your account area, or by the payment provider before confirmation.
Subscriptions renew automatically until canceled.
You authorize Flutty and its payment processors to charge the payment method you provide for recurring fees, taxes, and permitted charges.
Unless otherwise stated, fees are non-refundable except where required by law or stated in the Refund and Cancellation Policy.
We may suspend or limit paid features for failed payments, chargebacks, suspected fraud, abuse, or excessive risk.
You are responsible for taxes, VAT, duties, and similar charges unless the payment provider collects them directly.
Live sites
Publishing and hosting
Flutty may provide preview URLs, Flutty-managed live URLs, custom-domain features, usage limits, traffic quotas, and published-site analytics. We may remove, disable, rate-limit, or suspend previews or live sites that violate these Terms, create security risk, exceed limits, or cause infrastructure harm.
Providers
Third-party services
Flutty integrates with third-party services such as authentication, payment processors, GitHub, Supabase, hosting providers, email providers, analytics, AI/runtime providers, and infrastructure vendors. Your use of third-party services may be governed by their own terms and policies.
Flutty rights
Intellectual property
Flutty and its licensors own the service, software, design, trademarks, documentation, infrastructure, and all related intellectual property, except for your content. These Terms do not grant you any rights in Flutty's intellectual property except the limited right to use the service as allowed by these Terms.
Copyright
DMCA and infringement
If you believe content hosted through Flutty infringes your rights, contact `legal@flutty.dev` with enough detail for us to investigate. We may remove or disable content and terminate repeat infringers where required or appropriate.
Disclaimers
Availability, warranties, and limits
Flutty is provided "as is" and "as available." We do not guarantee uninterrupted availability, error-free output, exact generation results, merchantability, fitness for a particular purpose, or non-infringement.
Your responsibility
Indemnity
You will defend, indemnify, and hold harmless Flutty, its affiliates, officers, directors, employees, and agents from claims, damages, liabilities, costs, and expenses arising from your content, published sites, misuse of the service, violation of these Terms, or violation of law or third-party rights.
Enforcement
Suspension and termination
We may suspend or terminate access if you violate these Terms, create security or abuse risk, fail to pay required fees, or use the service in a way that could harm users, Flutty, providers, or infrastructure. You may stop using Flutty at any time.
Forum
Governing law and disputes
These Terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law rules. Courts located in Delaware have exclusive jurisdiction for disputes unless applicable law requires another forum.
Updates
Changes
We may update these Terms from time to time. Material updates will be posted with a revised effective date. Continued use after updates take effect constitutes acceptance of the revised Terms.
